Eight employers ordered to pay MPF non-payment

    The Mandatory Provident Fund Schemes Authority (MPFA) today (March 13) obtained two orders for payment of outstanding MPF contributions at about $140,000 against two employers in the District Court.  Meanwhile, the MPFA pursued six claims in the Small Claims Tribunal for some $148,000 on behalf of 12 employees, who were owed MPF contributions by their employers.

     The District Court today issued judgments against two employers, namely, Kwai Kee Iron Steel & Aluminium Engineering Limited and Aslchem International (HK) Limited. The defendants were ordered to pay the MPFA the sums of $90,607.67 and $59,806.14, being mandatory contributions in arrears and surcharges payable to four and one employees of the defendants respectively.

     The Adjudicator also ordered Aslchem International (HK) Limited to pay the MPFA the respective sum of $5,000 being financial penalty imposed by the MPFA for failure to make MPF contributions for employees.

     At the Tribunal's hearing today, the defendants, Chan Chi-keung trading as United Transportation & Trading Co, Citi-pro Security Co., Limited and Chan Ping-hong trading as Express Engineering Co., did not dispute the amounts claimed.  The Adjudicator ordered them to pay the MPFA the sums of $31,669.14, $29,927.24 and $26,083.1, being mandatory contributions in arrears and surcharges payable.

     The other three defendants, including Shui Chi-yeung Philp and Wu Chi-fai trading as Moon Fairy Garments Fty, Ever Allied Industries Limited trading as Luen Wing Dyeing & Printing Factory and Chan Wah On trading as Wah Kee Construction, did not appear at today's hearing.  In their absence, the Adjudicator ordered them to pay the MPFA the sums of $46,556.58, $10,655.12 and $4,033.51, being mandatory contributions in arrears and surcharges payable.

     The amounts both awarded at the District Court and the Tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court and the Tribunal respectively further awarded payments of $930 each for the District Court cases and $180, $320, $110, $250, $140 and $140 as the costs in respect of the Tribunal's claims.
