The Mandatory Provident Fund Schemes Authority (MPFA) today (March 27) obtained an order in the District Court for payment of outstanding MPF contributions at about $150,000 against an employer. The MPFA pursued three claims in the Small Claims Tribunal for some $81,000 on behalf of five employees, who were owed MPF contributions by their employers.
The District Court today issued a judgment against an employer, Waheungai Company Limited. The defendant was ordered to pay the MPFA $157,756.38, being mandatory contributions in arrears and surcharges payable to 33 employees.
At the tribunal's hearing today, the defendants, Ma Kwong Tak trading as Tak Hing Transportation Co. and Fung Yuk Man trading as Man Yin Investment Development Co., did not dispute the amounts claimed. The Adjudicator ordered them to pay the MPFA $37,732.97 and $10,368.92, being mandatory contributions in arrears and surcharges payable.
The other defendant, Kwok Ping Lam trading as Senior Cargo Co, did not appear at today's hearing. In its absence, the Adjudicator ordered it to pay the MPFA $34,650, being mandatory contributions in arrears and surcharges payable.
The amounts both awarded at the District Court and the tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court and the Tribunal respectively further awarded payments of $930 for the District Court case and $140, $70 and $150 as the costs in respect of the tribunal's claims.
