The Mandatory Provident Fund Schemes Authority (MPFA) today (April 4) pursued nine claims in the Small Claims Tribunal for some $250,000 on behalf of 22 employees, who were owed MPF contributions by their employers.
At the tribunal's hearing, two defendants - Chan Ping Hong trading as Express Engineering Co and Chan Wing Kei Vincenza & Chan Kin Bong trading as Oscar Collections - did not dispute the amounts claimed. The Adjudicator ordered them to pay the MPFA $73,306.09 and $6,765.55, being mandatory contributions in arrears and surcharges payable.
The other seven defendants - Creator Investments Limited trading as New Choice Seafood Restaurant, Keiyo Electronic Limited, Little Dynamites Interactive Learning Centre Limited, Shiu Chi Yeung Philip and Wu Chi Fai trading as Moon Fairy Garments Factory, Roysmart International Trading Limited, Wah Tai Farm Company Limited and Synerview Consulting (HK) Limited, did not appear at today's hearing. In their absence, the Adjudicator ordered them to pay the MPFA $48,837.17, $36,694.14, $30,555, $27,933.93, $22,591.04, $8,024.62 and $1,173.59, being mandatory contributions in arrears and surcharges payable.
The amounts awarded will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The tribunal further awarded $270, $170, $190, $170, $126, $200, $126, $270 and $76 as the costs in respect of the claims.
Wah Tai Farm Company Limited pleaded guilty at Kwun Tong Magistracy earlier to four counts of failing to make MPF contributions on time and was fined $10,500.
