Company and its directors fined for wage offences

     Walter Ma & Company Limited and its directors were prosecuted by the Labour Department for committing wage offences under the Employment Ordinance (EO). The company and its directors were convicted at Kwun Tong Magistrates' Courts today (December 29). The company was fined $33,500 while its two directors were each fined $46,000 and $15,000 respectively.

     The company failed to pay wages to an employee within seven days after the expiry of wage periods and termination of employment, as required by the EO. The total amount of wages involved was about $31,000.

     The two directors concerned were convicted as the above offences committed by the company were proven to have been committed with the consent or connivance of the two, or to be attributable to any neglect on their part.

     "The judgment will disseminate a strong message to all employers, directors, managers, secretaries and other similar officers of companies that they have to pay wages to employees in accordance with the EO," a spokesman for the Labour Department said.

     "The Labour Department does not tolerate the above offences and will spare no effort in enforcing the law and safeguarding employees' statutory rights," the spokesman added.
